bygora GmbH (hereinafter "bygora") has made it its goal to treat your data as securely and confidentially as possible. At the same time, we want to provide you with an excellent User experience. Who is responsible according to the General Data Protection Regulation (GDPR)?

Responsible for compliance with data protection regulations is bygora GmbH, Ettaler Str 21, 82061 Neuried, Germany. For the terminology used in these provisions, reference is made to the General Terms and Conditions of bygora. The entirety of the data processed by bygora is hereinafter referred to as "User Data".

According to the provisions of the GDPR, bygora is responsible for the protection of your personal data. This applies both to the use of the website and to the use of the bygora Marketplace. What personal data does the website process?

If the visit to the website of bygora takes place without registration for informational purposes only, bygora processes only the personal data that the User's browser transmits to the server of bygora and that are technically necessary to display the website and to ensure stability and security. These are: IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transferred in each case, website from which the request comes, browser, operating system and its interface, language and version of the browser software.

bygora has committed itself to the principle of data economy and tries to avoid the processing of personal data to the greatest possible extent. However, to the extent that we process personal data when you visit our website, this is done solely to make the use of our website as user-friendly as possible for you.

 

What personal data does the bygora Marketplace process?

In order to create a User profile ("Buyer Account" and "Seller Account"), bygora processes, among other things, the name, company, position in the company, telephone number and e-mail address of the User in addition to the data mentioned above. The data accruing in this context is deleted by bygora after the storage is no longer necessary; if legal retention obligations exist, bygora restricts the processing accordingly. The User Data is processed by bygora exclusively for the purpose of fulfilling the contract on the use of the bygora Marketplace (Art. 6 para. 1 p. 1 lit. b GDPR). The Marketplace User Data is processed by bygora on servers within the European Union. bygora undertakes to protect the privacy of the User and assures to process the User Data in accordance with the European data protection laws. bygora will oblige its employees accordingly.

When you create a Buyer Account or Seller Account, bygora requires some personal data from you. This data is technically necessary so that you can use the bygora Marketplace. The fact that such processing of personal data may be necessary is also recognized by the GDPR which explicitly permits this kind of processing.

 

What rights do I have regarding my personal data?

The User – with regard to any personal data processed by bygora in accordance with the so-called General Data Protection Regulation (GDPR) – has the right to information (Art. 15 GDPR), correction (Art. 16 GDPR), deletion (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), objection (Art. 21 GDPR) against the processing and data transferability (Art. 20 GDPR); these rights are to be exercised by sending a message by post to bygora GmbH, Ettaler Str 21, 82061 Neuried, Germany or by e-mail to support@bygora.com. Furthermore, the User has the right to complain to a data protection supervisory authority about the processing of his personal data by bygora.

The General Data Protection Regulation grants the data subject (i.e. you) many rights. Of course, bygora observes the European data protection laws. If you would like to exercise your corresponding rights, then it is best to simply send us an e-mail to support@bygora.com.

 

Does bygora use cookies?

The bygora website and the bygora Marketplace use transient and/or persistent cookies. Transient cookies are automatically deleted when the User closes the browser; in particular these include session cookies. Session cookies store a so-called session ID, with which various requests of the User's browser can be assigned to the common session. This means that the User's computer can be recognized when the User returns to this website and/or the bygora Marketplace. Session cookies are deleted when the User logs out or closes the browser. Persistent cookies are automatically deleted after a predetermined period of time, which may vary depending on the cookie. The User can delete the cookies in the security settings of his browser at any time. What about the bygora Newsletter?

With his consent, the User can subscribe to the bygora Newsletter, with which bygora informs the User about current interesting offers and news. The advertised services are named in the declaration of consent. For the subscription to the bygora Newsletter, bygora uses the so-called double opt-in procedure. This means that after registration, bygora sends the User an e-mail to the specified e-mail address, in which bygora asks the User to confirm that the User wishes to receive the newsletter. If the User does not confirm his registration within 24 hours, the User's information will be blocked and automatically deleted after one month. In addition, bygora stores the IP-addresses used by the User and the times of registration and confirmation. The purpose of this procedure is to be able to prove the registration of the User and, if necessary, to clarify a possible misuse of the User's personal data. Only the User's e-mail address is required for sending the newsletter. The provision of further, separately marked data is voluntary and is used in order to be able to address the User personally. After the User's confirmation, bygora stores the User's e-mail address for the purpose of sending the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a GDPR. The User can revoke the consent to the sending of the newsletter at any time and unsubscribe from the newsletter. The User can declare the revocation by sending an e-mail to support@bygora.com. bygora notifies the User that bygora evaluates the behavior of the User when sending the newsletter. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on the bygora website. For the evaluations, bygora links the data mentioned under the question "What personal data does the bygora Marketplace process?" and the web beacons with the User's e-mail address and an individual ID. Links received in the newsletter also contain this ID. With the data obtained in this way, bygora creates a User profile in order to tailor the newsletter to the User's individual interests. In doing so, bygora records when the User reads the newsletter from bygora, which links the User interacts with and concludes the personal interests of the User from this. bygora links this data to actions performed by the User on the website. The User can object to this tracking at any time by unsubscribing from the newsletter. The information is stored as long as the User subscribes to the newsletter. After unsubscribing, bygora stores the data purely statistically and anonymously.

How does the KYC check through Trulioo work?

For the KYC check, bygora uses the third-party service provider Trulioo Information Services Inc., 1200 - 1055 West Hastings Street, Vancouver, BC V6E 2E9, Canada. Trulioo's services are governed by Trulioo's Privacy Policy, available at https://www.trulioo.com/privacy. The legal basis for the KYC check is Art. 6 para. 1 p. 1 lit. f GDPR.

To increase the transparency and transaction security of the bygora Marketplace, we have opted for identity verification by the renowned provider Trulioo. Trulioo is our processor and is closely monitored by us for compliance with the relevant data protection regulations. In order to use Trulioo, we transfer or you transfer data to Trulioo's headquarters in Canada. Canada is a country which, in the opinion of the European Commission, has an adequate level of data protection. Therefore, the data transfer is permissible pursuant to Art. 44 and Art. 45 of the GDPR without having to meet further requirements.

 

What additional tools and cookies does bygora use?

bygora uses HTML5 Local Storage for the purpose of verifying the User's authorization to access the User profile and the bygora Marketplace. Through Local Storage, specific data related to the User is stored in the User's browser.

The website of bygora uses the cookie consent technology of Consent Manager Provider ("CookieYes") in order to obtain your consent to the storage of certain cookies on your end device and to document this in a data protection compliant manner. This tool records movements on the observed websites in so-called heatmaps. This allows bygora to recognize anonymously where visitors click and how far they scroll. This enables bygora to design its website in a better and more customer-friendly way. The protection of your personal data is very important to bygora when using this tool. All data is collected without bygora being able to assign it to specific Users. bygora can only track how the mouse was moved, where it was clicked and how far it was scrolled. Furthermore, the screen size of the device, the type of device, information on the browser, the country from which access was made and the preferred language are recorded. If personal data of you or third parties are displayed on a website, these are automatically hidden by Smartlook. Therefore, they are not traceable for bygora. The data is stored exclusively in data centers in the European Union (Frankfurt am Main, Germany and Dublin, Ireland), which are certified according to ISO 27001, 27017 and 2018 as well as PCI DSS Level 1. Of course, there are strictly limited access rights for AWS on the part of bygora and the data is automatically encrypted. As a company, AWS has subjected itself to so-called Binding Corporate Rules. For the services we offer, bygora uses the technical platform and services of Facebook Ireland Ltd, 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland. The services include "Facebook" and "Instagram" (hereinafter together "social media site", both operated by Facebook Ireland Ltd. bygora points out to the User that the User uses the social media site and its functions on his own responsibility. This applies in particular to the interactive functions (e.g. commenting, sharing, rating). Facebook processes personal data relating to the User's account, the User's IP address and the end devices used by the User; cookies are used for data collection. The data collected about the User in this context is processed by Facebook Ltd. and may be transferred to countries outside the European Union. If the User visits one of bygora's social media presences (e.g. Instagram), the User triggers a processing of his personal data during such a visit. The operating company of TradeTracker is TradeTracker Deutschland GmbH, Eiffestraße 426, 20537 Hamburg, Germany. TradeTracker sets a cookie on the information technology system of the data subject. The tracking cookie from TradeTracker does not store any personal data. Only the identification number of the affiliate, i.e. the partner referring the potential customer, as well as the order number of the visitor to a website and the advertising material clicked on are stored. The purpose of storing this data is to process commission payments between a merchant and the affiliate, which are processed via the affiliate network, i.e. TradeTracker.
